Vinall and Macey Upholstery Terms and Conditions
1. Scope of Services
a) Description of Services: Vinall and Macey provides upholstery, reupholstery, custom furniture, and repair services for residential and commercial customers. Our services may include fabric selection, foam replacement, cushion refills, and structural repairs.
b) Limitations: We do not provide structural modifications to furniture beyond what is necessary for upholstery purposes, unless specifically agreed upon in the service agreement.
2. Quotes and Estimates
a) Quotations: All price estimates are valid for 30 days from the date issued unless otherwise specified. Final costs may vary due to changes in the project scope or additional services requested by the customer.
b) Inclusions and Exclusions: Our quotes include labor, materials, and basic repairs necessary for upholstery. Additional repairs, fabric upgrades, or complex requests may incur extra charges.
3. Orders and Deposits
a) Order Confirmation: Orders are confirmed only upon receipt of payment of the requested deposit as stated on the estimate, and within the 30 day time frame.
b) Deposits: Deposits are non-refundable and cover material costs and time allocated to your project. Work will not commence until the deposit is received.
c) Payment of the deposit is seen as agreement to these Terms and Conditions.
4. Payments
a) Payment Terms: Full payment of the balance is due upon completion of the project. Payments can be made via cheque, cash, or bank transfer.
b) Late Payments: Any balance not paid within 30 days will incur a late fee of 5% per week until paid in full.
c) By paying your deposit, leaving your furniture or fabric with us, you agree to our terms and conditions.
5. Cancellation and Rescheduling
a) Customer Cancellation: Orders canceled within 21 days of order confirmation may be subject to a cancellation fee equivalent to 50%.
b) Business Rescheduling: We reserve the right to reschedule services in the event of unforeseen circumstances (e.g., supply chain delays, staff availability). Customers will be informed promptly.
6. Customer-Supplied Materials
a) Fabric and Materials: If the customer supplies fabric or materials, Vinall and Macey are not responsible for material quality, durability, or performance issues, including fading, shrinkage, or defects.
7. Warranty and Liability
a) Workmanship Warranty: We guarantee our workmanship for a period of 1 year from the completion date. This warranty covers labour-related issues but excludes normal wear and tear, misuse, or improper care.
b) Fabric Warranty: We do not warranty fabrics, leathers, or any customer-supplied materials. Warranties for materials, if applicable, are provided by the fabric manufacturers.
c) Limit of Liabiity: Vinall and Macey is not liable for any indirect, incidental, or consequential damages resulting from our services. In no case shall our liability exceed the amount paid by the customer for the specific service in question.
8. Care and Maintenance
a) Care Instructions: We can provide general care guidelines for upholstered items upon request. Customers are responsible for following these guidelines to maintain the longevity of their furniture. Improper care may void any applicable warranty.
9. Customer Satisfaction and Complaints
a) Resolution of Issues: We are committed to customer satisfaction. Any issues with our services should be reported within 7 days of project completion. We will assess and, if applicable, rectify the issue at no additional cost.
b) Complaint Procedure: Complaints or disputes regarding service quality or pricing should be submitted in writing to martin@vinallandmacey.com
10. Disposal of Uncollected Goods
10.1. Collection Period:
a) Customers are required to collect completed items within 2 months of being notified that the work is complete.
b) Storage Fees: If items are not collected within this period, Vinall and Macey reserves the right to charge a storage fee of £10 per week until the item is collected.
10.2. Extended Non-Collection:
a) Items that remain uncollected (fabric and/or furniture) for more than 12 months may be disposed of, or sold by Vinall and Macey under the Torts (Interference with Goods) Act 1977 to recover costs, including any unpaid balances and storage fees. The original owner will therefore lose all rights to the goods.
10.3.Notice of Disposal:
a) Prior to disposal, Vinall and Macey will make reasonable attempts to contact the customer through provided contact information. After such attempts, and if no arrangements are made, the item will be considered abandoned.
11. Governing Law
a) Jurisdiction: These terms and conditions are governed by the laws of England. Any disputes will be resolved in the courts of England.
